Warranty
New machines sold by FGP Solutions Inc (FGP) carry a one-year warranty effective from the date of shipping. Machines sold through dealers must be registered with FGP within 30 days of purchase to be covered by this warranty. All FGP mechanical components are warranted against manufacturer’s defects in material and workmanship for a period of 1 year from the time of shipment from FGP facilities. All FGP electrical components are similarly warranted for a period of 1 year from the time of shipment from FGP’s facilities. FGP’s sole obligation under this warranty is limited to repairing the product or, at its option, replacing the product, without additional charge, provided the item is properly returned to FGP for repair as discussed below. Modification to machine parts and components will void this warranty. Tampering or removal of FGP product labels and marking will void this warranty. We require that the defective item/part be returned to FGP with the complaint. Any machines returned to FGP must be returned with packaging in the same manner in which it was received. The provisions of this warranty shall not apply to any product which has been subjected to tampering, abuse, improper set up or operating conditions, misuse, and lack of proper maintenance or unauthorized user adjustment. FGP makes no warranty that its products are fit for any use or purpose to which they may be put by the customer, whether or not such use or purpose has been disclosed to FGP in specifications or drawings previously or subsequently provided, and whether or not FGP’s products are specifically designed and/or manufactured for such a purpose. This limited warranty does not apply to natural disasters, acts of terrorism, normal wear and tear, product failure due to lack of maintenance or cleaning, damage caused by accident, neglect, lack of or inadequate dust collection, misuse/abuse or damage caused where repair or alterations have been made or attempted by others.
NOTE: Drive motors (servo or stepper) are considered “mechanical components”.
Limitation of Remedy
In no event shall FGP be liable for any incidental, consequential or special damages of any kind or nature whatsoever. FGP is in no way liable for any lost profits arising from or connected to this agreement or items sold under this agreement, whether alleged to arise from breach of contract, expressed or implied, or in tort, including, without limitation, negligence, failure to warn, or strict liability.
One year spindle warranty
FGP guarantees that this electro-spindle has been QC passed in testing in the factory. FGP accepts responsibility only for defects in electrical and mechanical parts. The warranty does not cover defects caused by the normal use of parts subject to continuous or rapid wear (e.g. seals, belts, bearings, etc.). In particular FGP offers no guarantee as to the duration of bearings, since bearing wear depends on various factors including: tool balancing precision, type of machining operation, impacts and/or mechanical stress in excess of the manufacturer’s declared limits. FGP declines all responsibility for non-compliance of the electro-spindle caused by failure to follow the precautions and instructions given in this manual or by improper use or handling of the electro-spindle. The customer has the right to replacement of all parts shown to be defective, unless the said defects are caused by unauthorized tampering, including the fitting of non-original FGP spare parts and/or the replacement of parts not described or authorized in this manual unless authorized beforehand and in writing by FGP. In no case shall FGP or its suppliers accept any responsibility for damage (including damage to the unit, damage incurred for lost production and income, down-time in manufacturing, loss of information or other economic losses) deriving from the use of FGP products, even if FGP has been advised of such risks in advance. The warranty becomes automatically null and void if the customer fails to notify FGP in writing of any faults found in the electro-spindle within 15 days of their occurrence. The warranty likewise becomes null and void if the customer fails to permit the seller to perform all necessary checks and tests, and if, when the seller requests the return of a defective part, the customer fails to do so within two weeks of the request. Dimensioned drawings and photographs are provided only for information purposes and to facilitate understanding of text. FGP has a policy of constant development and improvement, and reserves the right to make functional and stylistic modifications to its products, to change the design of any functional or accessory part, and to suspend manufacturing and supply without notice and without obligation to third parties. Furthermore, FGP reserves the right to make any structural or functional change to the units, and to change the supply of spare parts and accessories without any prior notice.
Return Procedure
Before returning any equipment in or out of warranty, the customer must first receive a return authorization number and packing instructions from FGP. No claim will be allowed nor credit given for products returned without such authorization. Proper packaging and insurance for transportation is solely the customer’s responsibility. After approval from FGP, the product should be returned with a statement of the problem and transportation prepaid. If upon inspection, warranted defects exist, the product will be repaired or replaced at no charge and shipped, prepaid, back to the customer. Return shipment will be by common carrier (e.g. UPS). If rapid delivery is requested by the customer, then such transport is at the customer’s expense. If an out-of-warranty situation exists, the customer will be notified of the repair costs immediately. At such time, the customer must issue a purchase order form to cover the cost of the repair or authorize the product to be shipped back as is, at the customer’s expense. In any case, a restocking charge of 30% will be charged on all items returned to stock. Refund of purchase will be issued once returned items is back to stock, inspected and resold to a new buyer. FGP only accepts the return process within the first 30 days of purchase.
Field Service
Repairs are ordinarily done at FGP’s Vancouver, Canada facility where all necessary instrumentation is available. This instrumentation is difficult to transport so that field service is severely limited and will only be supplied at FGP’s discretion. If field service is required and is performed at FGP’s sole discretion, all relevant expenses, including transportation, travel time, subsistence costs, and the prevailing cost per hour (eight hour minimum) are the responsibility of the customer.
Unforeseen Circumstances
FGP is not liable for delay or failure to perform any obligations hereunder by reason of circumstances beyond its reasonable control. These circumstances include, but are not limited to, accidents, acts of God, strikes, or labor disputes, laws, rules, or regulations of any government or government agency, fires, floods, delays or failures of carriers or suppliers, shortages of materials, and any other event beyond FGP’s control.
Entire Agreement / Governing Law
The terms and conditions contained herein shall constitute the entire agreement concerning the terms and conditions for the limited warranty described hereunder. No oral or other representations are in effect. This agreement shall be governed in all respects by the laws of British Columbia. No legal action may be taken by any party more than 1 year after the date of purchase.
FGP reserves the right to change designs, specifications, prices, and any applicable documentation without prior notice.
